Terms & Conditions for Online Only Orders
Important: These terms and conditions (Terms) apply to the purchase of goods marked on our website and available to purchase as “Online Only” or “Special Order”. These purchases are referred to herein as an “Online Only order”.
These Terms apply in conjunction with our website terms and conditions, in the event of an inconsistency these Terms apply.
References to 'us' and ‘we’ mean Spotlight Pty Ltd as trustee for the Spotlight Stores Trading Trust ABN 39 564 861 886 (Spotlight) and include its related bodies corporate and associates as those terms are defined in the Corporations Act 2001 and references to 'you' mean you, the consumer.
By placing an Online Only order, you are deemed to have accepted these Terms.
The delivery fee for Online Only orders is included in the price of the goods and no additional fee is applied.
Delivery times may vary and any estimates provided are subject to stock availability and delays which are beyond our reasonable control (including but not limited to postal delays and force majeure events).
You must ensure there is clear and safe access for delivery. Please ensure there is a person present at the delivery premises who is authorised by you to accept delivery. If there is not, we will endeavour to deliver the goods anyway (if we consider it is safe and appropriate to do so).
NO RETURN FOR CHANGE OF MIND
Due to the nature of Online Only orders Spotlight is unable to provide customers with a refund due to a change of mind.
All goods purchased from Spotlight come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
If there is a problem with an item you have purchased from Spotlight you can return it to us.
Online Only orders cannot be returned to stores. In order to return an Online Only order please contact our customer care team on 1300 305 405.
After receiving your faulty item Spotlight will assess the fault and will offer a full refund or replacement if there is major problem with the item. We may offer of a repair or replacement if the problem is not major.
You must provide us with your proof of purchase (e.g. your Spotlight receipt, online tax invoice, credit card or bank statements). Any refund will be provided via the same method of payment as the original purchase.
Please note that Spotlight is not responsible for any postage costs associated with returned goods, except in cases where the items have been recalled or you are entitled to a remedy under Australian Consumer Law.
To assist us in resolving any problems you may experience, please inspect the goods upon taking delivery and report any shortage, discrepancy, defect, wrong specification or similar problem to us as soon as you become aware of it.
By placing an Online Only order with us, you consent to us providing your name, contact details and delivery address to third parties (including our suppliers or delivery contractors) for the purpose of fulfilling and delivering your order. If you have any questions, email us at email@example.com.
In the event of any inconsistency between these Terms and any other terms and conditions, document or policy, these terms will take precedence.
Spotlight reserves the rights to change these Terms without prior notice.
